This document constitutes a public offer for entering into an agreement for the preparation and delivery of products (hereinafter referred to as the “Goods”) under the “BESSO BURGER” trademark in accordance with Article 369 of the Civil Code of the Republic of Uzbekistan.
A person who accepts this offer, places an order, and fulfills the established requirements using the information and materials published on the official BESSO BURGER website (hereinafter referred to as the “Website”) shall be deemed to have entered into an agreement under the terms set forth in this document.
Unless otherwise stated in the text, the following terms shall have the following meanings:
1.1.1. “Courier Service” — persons delivering the Goods on behalf of the Seller or being employees of the Seller.
1.1.2. “Seller” — EVEREST-BURGER LLC, a legal entity selling the Goods in accordance with the legislation of the Republic of Uzbekistan. The full name and address of the Seller are indicated on the Website.
1.1.3. “Buyer” — a legally capable individual or legal entity purchasing the Goods for personal, family, household needs, as well as for purposes unrelated to entrepreneurial activities.
1.1.4. “Website” — the official BESSO BURGER website: besso.uz.
1.1.5. “Telephone” — the Seller’s contact number: +998 78 555 19 08.
1.1.6. “Goods” — products presented on the Website. The appearance of the Goods may differ from the images published on the Website.
Words used in the singular may be understood in the plural, and words used in the plural may be understood in the singular, where required by the context.
2.1. The Seller and the Buyer confirm that they possess the necessary rights and legal capacity to enter into and perform the Agreement.
2.2. The Buyer is required to familiarize themselves with the terms of this Offer, information about the Goods, the Privacy Policy, and the User Agreement.
2.3. The Seller reserves the right to make amendments to this Offer. The Buyer undertakes to independently monitor the current version of the Offer.
2.4. By placing an order, the Buyer shall be deemed to have agreed to all terms of this Offer.
2.5. The Agreement shall be deemed concluded from the moment the Buyer confirms the order by clicking the relevant button on the Website or receives a notification regarding the acceptance or readiness of the order.
2.6. Unless otherwise stated on the Website, this Offer shall remain valid indefinitely.
3.1. The Seller provides the Buyer with the Goods at the prices indicated on the Website and delivers them through the Courier Service. The Buyer accepts the Goods and makes payment for them.
3.2. Ownership of the Goods shall transfer to the Buyer upon the actual delivery of the Goods to the Buyer.
4.1. The Seller has the right to send advertising and promotional messages with the Buyer’s consent.
4.2. The Buyer may refuse to receive advertising and promotional messages or resume receiving them at any time.
4.3. The Seller may conduct marketing research and make calls with the Buyer’s consent.
4.4. Notifications directly related to the fulfillment and status of an order are sent automatically and constitute a necessary part of the Buyer’s service.
5.1. Orders are placed through the Website, mobile application, Telegram bot, or by telephone, if such methods are provided by the Seller.
5.2. The Buyer is required to provide accurate and reliable information necessary for the proper fulfillment of the order.
5.3. If the Buyer has any questions regarding the Goods before placing an order, the Buyer may contact the Seller using the specified contact number.
5.4. An order may only be placed for Goods available for ordering at the time the order is placed.
5.5. Telephone conversations may be recorded for the purpose of improving the quality of service.
6.1. Delivery is carried out within the areas served by the Seller, to the address specified by the Buyer when placing the order.
6.2. The delivery fee is determined in accordance with the Seller’s current terms and depends on the delivery zone and/or distance to the specified address.
6.3. The estimated delivery time is 40–50 minutes from the moment the order is received and confirmed. In unforeseen circumstances, the delivery time may be extended to 90 minutes.
7.1. Prices for the Goods are indicated in Uzbek soums. Payment is made in cash or by bank card, as well as by other payment methods available on the Website.
7.2. When paying in cash, the Buyer shall be provided with the relevant payment document.
8.1. Food Goods of proper quality are not subject to return or exchange unless otherwise provided by the applicable legislation of the Republic of Uzbekistan.
8.2. In the event of a defect or quality discrepancy in the Goods, the Buyer may contact the Seller with a request to replace the Goods within 1 hour from the moment of receipt, provided that the relevant defect is confirmed.
9.1. In the event of force majeure circumstances, the parties shall be released from liability for full or partial non-performance of their obligations for the duration of such circumstances.
10.1. All disputes and disagreements arising between the parties shall be resolved through negotiations. If an agreement cannot be reached, the dispute shall be considered in court in accordance with the applicable legislation of the Republic of Uzbekistan.
11.1. This Offer is an official document of EVEREST-BURGER LLC. All appendices and amendments thereto constitute an integral part thereof.
11.2. If any provisions of this Offer are declared invalid or cease to have legal effect, this shall not affect the validity of the remaining provisions of the Offer.
